1 – OBJECT
The general conditions of sale described below detail the rights and obligations of the company SAM MONACAIR and its client in connection with the sale of passenger transport by helicopter on the airport transfer Monaco – Nice Aéroport Côte d’Azur – Mo¬ Naco. Any service marketed and performed by the company SAM MONACAIR implies the unreserved acceptance of the buyer to these general conditions of sale (GTC).
2 – CONDITIONS OF THE CONTRACT FOR THE TRANSPORT OF PERSONS
MONACAIR undertakes to implement the means at its disposal to transport the passa¬ger and its luggage within a reasonable time. In the case of a flight interruption, MONACAIR will organize the routes via another means within a reasonable time. The carrier may, without notice to substitute other carriers, use other aircraft; He may modify or delete the stops on the ticket if necessary. As stipulated in the Warsaw Convention (12/01/1929) and the Montreal Convention (28/05/1999). The Warsaw Convention governs, and in most cases, limits the carrier’s liability for death or personal injury, as well as for the loss or damage of baggage. Schedules shown on the website www.monacair. mc and the different pricing scales disseminated by MONACAIR and its partners may be subject to changes due to the imperatives related to the management of operations and contingencies. They are not guaranteed and have no contractual value. They are subject to change without notice.
MONACAIR declines any responsibility in case of flight in correspondence with the airlines.
The passenger agrees to have read the formalities imposed by the authorities and to be provided with identity documents and any other proof necessary for both MONACAIR and the companies with which it has agreements. The passenger must also ensure that the connection times are sufficient.
The passenger agrees to arrive in time for check-in, ie at least 20 minutes before the departure time.
Beyond this check-in time, MONACAIR on a commercial basis will endeavor to route passengers on the first available flight. In the case of a delay of passengers at check-in. MONACAIR can not be held responsible in the following cases:
i. Passenger delay outside check-in times as specified above.
ii. In the case of a lack of availability of helicopter or seats.
iii. Arrival outside the check-in hours, preventing transportation on the last flight of the day.The passenger undertakes to communicate to MONACAIR any information requiring special care (baby, fragile baggage or dimensions outside the authorized standard, person having difficulty to move, animals …)
MONACAIR reserves the right to refuse boarding and, more generally, transport to any person who does not fulfill the above-mentioned conditions, as well as to any person having a behavior that the MONACAIR representative considers likely to be detrimental to the smooth running of the flight or transportation including but not limited to intoxication, aggressive or inappropriate attitude.
3 – CONDITIONS OF THE
BAGGAGE TRANSPORT CONTRACT MONACAIR authorizes 1 piece of standard size luggage per person (60 X 45 X 25) – Maximum weight: 21 kg. MONACAIR invites passengers to prefer soft luggage. The passenger undertakes to communicate to MONACAIR at least 24 hours in advance any information requiring special care (additional luggage (s), fragile luggage or dimensions outside the authorized standard, stroller, animals, etc.. .) and assume the cost if necessary. Apart from these conditions, MONACAIR declines any responsibility in the event of delay for the helicopter transfer and for the aircraft connections. Any baggage that does not correspond to the imposed standard will be sent as soon as possible by air or by land and submitted to extra charge.
** SPECIFIC CONDITIONS FOR THE BAGGAGE MANAGEMENT THURSDAY AND MONDAY OF THE GRAND PRIX:
– A supplement of 25 € per passenger and per transfer will be charged for any additional luggage
4 – TARIFF CONDITIONS AND TAXES
The valid rates are those applied at the time of the ticket issue. They include airport taxes. In case of extra charge, MONACAIR undertakes to implement the means to contact the customer who made the reservation within 24 hours before the flight (provided that the contact details in the customer profile are valid, and that the customer was accessible).
5 – CONDITIONS OF PAYMENT
No reservation is considered as finali¬sée before payment of 100% of the total amount TTC and issue of ticket or electronic ticket.
Reservations made on the website www.monacair.mc can be paid by credit card only.
Bookings made at the Ap¬pel Center or at the MONACAIR counter can be paid by credit card, in cash, or by Monegasque check. Payment by check is not accepted within 14 days of the flight.
MONACAIR declines all responsibility (s) in case one of these means of payment could not be accepted following any technical malfunction. MONACAIR reserves the right to refuse access to any person who has not paid 100% of the ticket price inclusive of VAT, and to any holder of a ticket or electronic ticket whose payment has been suspended, opposed or not validated.
6 – MODIFICATIONS
MONACAIR authorizes modifications up to 2 hours before take-off time only by telephoning the Reservations Service during opening hours: Morning flights until 10:30 am must be modified the day before in the morning. time slots specified below.

The letter of complaint must be written in French or in English. In case of refund, payment by MONACAIR will be made within 30 days after acceptance.
7 – CANCELLATIONS
MONACAIR authorizes cancellations up to 2 hours before take-off time only by telephone with the Reservations Department. Morning flights until 10.30 am must be canceled the day before at the times specified below.

Cancellation fees :
- GOING SIMPLE: € 40 penalty per coupon, per passenger.
- GO BACK: 60 € penalty per coupon, per passenger.
- NO SHOW: Not refundable except for the total amount of passenger taxes.
Cancellation fees Grand Prix period (from Thursday to Monday):
- More than 1 month before the flight: 30% penalty
- 1 month to 7 days before the flight: 50% penalty
- Less than 7 days before the flight: 100% penalty
- NO SHOW: 100% penalty
Any complaints must be sent by registered mail within 14 days of the canceled flight to:

8 – VALIDITY
The Premium card is valid from the payment of the membership of 200 € TTC by the Member. It is valid for one year renewable, without tacit renewal.
9 – MONACO SHUTTLE SERVICE CONDITIONS MONACO
The MONACAIR service includes the transfer between the heliport and an address in Monaco by non-private shuttle. For a better service, we invite you to book your shuttle when booking your helicopter flight.
On arrival in Monaco: Non-private shuttle transportation will be carried out as soon as possible taking into account traffic-related imponderables. Delays related to travel times will not be attributable to MONACAIR. Passengers who have not pre-booked their shuttle will not be priority. For passengers departing from Monaco: The shuttle must be booked at the time of booking, or by calling the Reservations Service before 10:30 the day before the flight. Outside this period, shuttle subject to confirmation. With regard to pickups and considering that it is about transfers on the airport transfer and not of private flights, it is asked the travelers their greater punctuality to avoid any delay. MONACAIR will decline any responsibility in case of delay of the travelers to their (them) pick-up. Passengers will,
10 – RESOLUTION OF DISPUTES :
If a dispute arose between the parties involved, the resolution of the latter would first be amicable. In the event that the amicable agreement of the parties proves impossible, the dispute would be brought before the competent Monegasque authority.
